PETER RIVNER ENFORCES ALIMONY AWARD OVERCOMING COHABITATION DEFENSE

The trial court held ex-husband in contempt after he stopped paying alimony to Peter Rivner’s client. The ex-husband claimed he had a contractual right to terminate alimony after he discovered that Peter’s client was living with her boyfriend out-of-state. Peter successfully argued that his client was not cohabitating in a meretricious relationship to allow for the termination of alimony and that ex-husband’s actions were unjustified. The Court ordered ex-husband to immediately pay Peter’s client the alimony due, as well as to reimburse Peter’s client 100% of her legal fees.
